The rules, rights, and responsibilities governing your use of Mtaa Jobs
Welcome to Mtaa Jobs (https://mtaajobs.co.ke). These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("user", "you") and Mtaa Jobs ("we", "us", "our").
By accessing or using our platform — including browsing, registering an account, posting a job, expressing interest in a job, using any free tool, or downloading any document — you confirm that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy.
If you are using Mtaa Jobs on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.
Mtaa Jobs is a Kenya-based online job marketplace that connects job seekers with job givers (employers) at the neighbourhood level — from county to subcounty to ward. Our platform enables:
- Job seekers to create profiles, list their skills, and express interest in job opportunities.
- Job givers (employers) to post job vacancies and discover local talent.
- Both parties to communicate, exchange ratings, and build reputations on the platform.
- Access to free productivity tools including a CV Builder, Invoice Maker, Smart-Gig Agreement Maker, Savings Tracker and Done List.
Mtaa Jobs is a facilitator only. We do not employ job seekers, guarantee employment, guarantee payment, or act as a party to any employment contract, gig agreement, or financial transaction between users.
- You must be at least 18 years of age to register and use Mtaa Jobs.
- You must be legally permitted to work in Kenya or to hire workers in Kenya.
- You must provide accurate, complete, and current registration information.
- Persons who have been previously banned or suspended from Mtaa Jobs may not re-register without our explicit written permission.
- Our free tools (CV Builder, Invoice Maker, etc.) may be used by guests without registration, but certain features require a registered account.
- Registration: You may register as a Job Seeker or a Job Giver. Each user may hold only one account per role.
- Accuracy: You are responsible for providing accurate information and keeping your profile up to date.
- Account security: You are solely responsible for maintaining the confidentiality of your password. You agree to notify us immediately at info@mtaajobs.co.ke if you suspect unauthorised access to your account.
- Account activity: You are responsible for all activities that occur under your account, whether or not authorised by you.
- Account deletion: You may delete your account at any time from your dashboard. Deletion is permanent and cannot be undone. All your data, including saved CVs, invoices, and job listings, will be permanently removed.
- One account per person: Creating multiple accounts to circumvent suspensions or bans is prohibited and will result in all accounts being permanently terminated.
By using Mtaa Jobs, you agree to:
- Provide truthful, accurate, and complete information in your profile, job postings, and all communications.
- Treat all other users with respect and professionalism, both on and off the platform.
- Respond honestly and promptly to messages, job interest requests, and status updates.
- Not misrepresent your skills, qualifications, identity, or work history.
- Not post job listings for illegal work, work that violates Kenyan labour laws, or work intended to exploit or harm others.
- Not use the platform to collect other users' contact information for any purpose outside of legitimate job-related engagement.
- Not engage in any activity that interferes with or disrupts the platform's operation or servers.
- Comply with all applicable Kenyan laws, including the Employment Act 2007, the Data Protection Act 2019, and any other relevant legislation.
All job listings and user profiles on Mtaa Jobs are created and posted by independent users. Mtaa Jobs does not screen, verify, or endorse any job posting or user profile.
- No employment guarantee: Appearing on Mtaa Jobs does not guarantee that a job seeker will find work, or that a job giver will find a suitable candidate.
- No verification: We do not verify the identity, skills, qualifications, criminal history, or background of any user. Users are responsible for conducting their own due diligence before hiring or accepting a job.
- Job giver responsibility: Job givers are responsible for ensuring their job postings comply with Kenyan employment law, including minimum wage requirements, safe working conditions, and non-discrimination obligations.
- Job seeker responsibility: Job seekers are responsible for accurately representing their skills and experience and for assessing the legitimacy and safety of any job before accepting it.
- Removal of listings: We reserve the right to remove any job listing or profile that we determine, at our sole discretion, to violate these Terms or to be harmful, misleading, or inappropriate.
- Guest postings: Job listings posted without a registered account expire automatically after 7 days and cannot be edited or deleted by the poster.
Mtaa Jobs provides the following free tools: CV Builder, Invoice Maker, Smart-Gig Agreement Maker, Savings Tracker and Done List. By using these tools, you agree that:
- The tools are provided "as is" for convenience and general use. They do not constitute legal, financial, or professional advice.
- Documents generated (CVs, invoices, agreements) are the user's own responsibility. Mtaa Jobs does not guarantee their legal enforceability, accuracy, or suitability for any specific purpose.
- Logged-in users' tool data is saved to our servers and visible in their dashboard. Guest data is stored in the browser's localStorage only, except where explicitly noted (e.g. invoices submitted for verification).
- You may not use our free tools to generate fraudulent, misleading, or illegal documents.
- We reserve the right to modify, suspend, or discontinue any tool at any time without notice.
- Invoices generated on Mtaa Jobs are user-created documents. Mtaa Jobs does not issue invoices on behalf of any user.
- The invoice number, amounts, parties, and all details are entered entirely by the user. Mtaa Jobs does not verify the accuracy of any invoice.
- Logged-in users' invoices are saved to their account and can be viewed, shared, and deleted from their dashboard.
- Guest invoices are stored temporarily for verification purposes. Guests cannot manage (edit or delete) their invoices after generation. We recommend creating a free account to maintain full control.
- The Invoice Verification page (verify-invoice) allows third parties to confirm an invoice was generated on Mtaa Jobs. This does not constitute endorsement of the invoice's contents.
- Mtaa Jobs is not responsible for any financial dispute, non-payment, or legal matter arising from the use of invoices generated on our platform.
- You may not use the Invoice Maker to generate fraudulent invoices, inflate amounts, or deceive clients or third parties.
- Smart-Gig Agreements generated on Mtaa Jobs are templates provided for general reference only. They do not constitute legal advice and should not be treated as a substitute for professional legal counsel.
- The enforceability of any agreement generated on our platform depends on the specific circumstances, applicable Kenyan law, and the conduct of both parties — factors outside our control.
- Mtaa Jobs is not a party to any agreement created using our tools and accepts no liability for disputes arising from such agreements.
- Users are encouraged to seek independent legal advice before entering into binding contracts, especially for high-value or long-term engagements.
- Generated agreement documents are stored with a unique verification ID. Do not share your document ID with parties who are not involved in the agreement.
Mtaa Jobs does not process, hold, or facilitate any payment between job seekers and job givers. All financial transactions are conducted directly between users outside of the Mtaa Jobs platform.
- Mtaa Jobs has no role in agreeing, negotiating, or enforcing payment terms between users.
- Mtaa Jobs is not responsible for non-payment, underpayment, fraud, or any financial dispute between users.
- Users who include M-Pesa or bank details on invoices or profiles do so at their own discretion. Mtaa Jobs does not verify the accuracy of payment details listed by users.
- If you are a victim of payment fraud by another user, we encourage you to report the user to us and to the relevant Kenyan authorities (DCI Kenya).
- Use of our platform is entirely free of charge for both job seekers and job givers. We do not charge commission on any job or transaction.
- Users who have been marked as "Hired" may rate and review each other after a job is completed.
- Ratings and reviews must be honest, fair, and based on genuine work experience. Fake, malicious, or retaliatory reviews are prohibited.
- Mtaa Jobs does not verify the accuracy of reviews but reserves the right to remove any review that violates these Terms, is defamatory, or is otherwise inappropriate.
- Attempting to manipulate your rating — including offering incentives for positive reviews or threatening negative reviews — is a violation of these Terms and may result in account termination.
- Reviews are public and visible to all users on the platform.
The following activities are strictly prohibited on Mtaa Jobs and will result in immediate account suspension or permanent termination:
- Posting false, misleading, or fraudulent job listings or profiles.
- Impersonating another person, company, or organisation.
- Harassment, threats, abuse, or discrimination of any kind against other users.
- Spamming users with unsolicited messages or job offers outside of legitimate platform use.
- Scraping, crawling, or systematically extracting data from Mtaa Jobs using automated tools.
- Attempting to hack, disrupt, or overload our servers or infrastructure.
- Using Mtaa Jobs to advertise or promote illegal services, including underage labour, trafficking, or any activity prohibited under Kenyan law.
- Creating multiple accounts to evade bans or inflate ratings.
- Using our free tools to generate fraudulent invoices, fake agreements, or falsified CVs intended to deceive employers, clients, or third parties.
- Reverse-engineering, copying, or reproducing any part of the Mtaa Jobs platform without authorisation.
- All content on Mtaa Jobs — including the logo, platform design, source code, written content, graphics, and tool interfaces — is the intellectual property of Mtaa Jobs or its licensors.
- You may not copy, reproduce, distribute, modify, or create derivative works from any part of our platform without our express written permission.
- Your content: By posting content on Mtaa Jobs (profiles, job listings, messages, reviews), you grant Mtaa Jobs a non-exclusive, royalty-free licence to use, display, and distribute that content on our platform for the purpose of providing our services.
- Documents you create using our free tools (CVs, invoices, agreements) remain your own intellectual property.
- The Mtaa Jobs name and logo are trademarks of Mtaa Computer Services. You may not use them without our prior written consent.
Mtaa Jobs is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement.
- Guarantees of uninterrupted, error-free, or secure access to the platform.
- Guarantees that job listings are legitimate, accurate, or safe.
- Guarantees that user profiles, skills, or qualifications are verified or accurate.
- Guarantees that documents generated by our tools are legally enforceable in any jurisdiction.
To the maximum extent permitted by Kenyan law, Mtaa Jobs, its directors, employees, agents, and partners shall not be liable for:
- Any direct, indirect, incidental, consequential, or punitive damages arising from your use of the platform.
- Any loss of earnings, non-payment, or financial loss resulting from engagements between users.
- Any physical harm, injury, or property damage arising from jobs arranged through the platform.
- Any reliance on the accuracy of user profiles, job listings, reviews, or AI-generated content.
- Any unauthorised access to or alteration of your data, despite our security measures.
- Any loss of data resulting from platform downtime, technical failure, or deletion of your account.
- Any losses arising from the use of documents generated by our free tools.
Our total aggregate liability to you for any claim, regardless of the form, shall not exceed KSh 5,000 (Five Thousand Kenya Shillings) or the amount you have paid us (if any) in the preceding 12 months, whichever is lower.
You agree to indemnify, defend, and hold harmless Mtaa Jobs and its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with:
- Your use of the Mtaa Jobs platform or free tools.
- Your violation of these Terms.
- Content you post, documents you generate, or actions you take on the platform.
- Any dispute between you and another user.
- Your violation of any applicable Kenyan law or third-party rights.
- We reserve the right to suspend or permanently terminate your access to Mtaa Jobs at any time, with or without notice, for any violation of these Terms or for conduct we deem harmful to the platform or its users.
- You may delete your own account at any time from your dashboard. This constitutes voluntary termination of your agreement with us.
- Upon termination — whether by you or by us — your profile, job listings, messages, and saved tool data will be permanently deleted from our platform.
- Provisions of these Terms that by their nature should survive termination (including Sections 13, 14, 15, 16, and 19) shall continue to apply after termination.
- Termination does not affect any rights or obligations that arose before the date of termination.
Your use of Mtaa Jobs is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully to understand how we collect, use, and protect your personal data in compliance with the Kenya Data Protection Act 2019.
By using Mtaa Jobs, you consent to the collection and use of your information as described in our Privacy Policy.
- These Terms are governed by and construed in accordance with the laws of Kenya, without regard to conflict of law provisions.
- Any dispute, controversy, or claim arising out of or relating to these Terms or the use of Mtaa Jobs shall first be attempted to be resolved through good-faith negotiation between the parties.
- If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Nairobi, Kenya.
- Nothing in these Terms prevents either party from seeking urgent injunctive or equitable relief in any court of competent jurisdiction.
Mtaa Jobs may revise these Terms at any time. When we make material changes we will:
- Update the "Last updated" date at the top of this page.
- Notify subscribed users by email of significant changes at least 14 days before they take effect.
- Display a prominent notice on the platform for at least 14 days.
Your continued use of Mtaa Jobs after updated Terms are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the platform and delete your account.
